This protocol applies to the implementation of Article 38.2.7
a. If a renewable adjunct indicates in writing to the head/dean that he or she will accept a new three year term, the head/dean shall review the Member's personnel file (including annual reports and teaching evaluations) and the unit's plans for the upcoming year.
b. If the head/dean concludes that none of the grounds for non-renewal in 38.2.5 apply, the head/dean should advise the Committee, as defined in Article 13.1, of the decision to renew. The Member shall be renewed unless the Committee, after reviewing the personnel file, is of the provisional opinion that 38.2.5 (a) may apply.
If either the Committee or the head/dean is of the provisional opinion that 38.2.5 (a) may apply, the head/dean shall prepare a file for the Committee to consider before formulating its recommendation. The head/dean shall advise the Member that he/she can submit relevant material to the Committee including student evaluations, material from colleagues or other referees. The head/dean should offer a renewal unless persuaded, after receiving the Committee's recommendation, that 38.2.5 (a) applies.
a. If the head/dean decides to discontinue or re-assign the duties performed by the Member in accordance with 38.2.5 (d) i., the head/dean shall notify the Member of the Committee and shall seek the recommendation of the Committee on the issue of whether the Unit offers other courses or needs other services which the Member is demonstrably qualified to provide in accordance with 38.2.5 (d) ii.
b. The Member shall have a reasonable opportunity to submit material to the Committee relevant to the issue of qualification to teach such courses. If the course is one which the Member has previously taught with satisfactory assessment, it shall be presumed that the Member is demonstrably qualified to teach it.
c. After receiving the Committee's recommendation, the head/dean shall assign such courses to the Member, unless persuaded that there are no such courses offered which the Member is demonstrably qualified to teach, and shall renew the Member if the number of courses is sufficient to place the Member back in the bargaining unit.
